General Conditions of Sale

These General Conditions of Sale ("Conditions") govern all auctions conducted by Roxburys Pty Ltd ("Auctioneer"). By participating in the auction, all bidders and purchasers ("Purchasers") agree to these Conditions.

1. Estimates

1.1 Purpose of Estimates

Estimates in the auction catalogue serve as a guide only. Final sale prices may differ from these estimates.

1.2 Basis for Estimates

For regular items, estimates reflect current market values. For rare or unique items, estimates are educated approximations and may vary significantly from the final sale price.

2. Collection and Payment

2.1 Payment Requirements

No lots will be released until full payment is received. Accepted payment methods include:

  • Bank Cheque
  • Credit Cards: Visa and Mastercard (1.5% processing fee; no fees for debit cards)
  • Postal Bidders: Invoices will be sent immediately, with prompt payment required. Late payments may incur additional fees.
  • Overseas Clients: Payments must be made via bank transfer.

2.2 Collection Procedures

Purchased lots must be collected within seven (7) days of the auction. After this period, a holding fee of fifty dollars ($50) per day will apply. Collections can occur 48 hours after invoice issuance, with prior notification to the auction house.


3. Ownership of Goods

3.1 Transfer of Ownership

Ownership of purchased lots transfers only upon receipt of full payment. If personal cheques are accepted, ownership transfers only after the cheque clears.


4. The Purchaser

4.1 Bidding Authority

The highest bidder, as determined by the Auctioneer, is deemed the Purchaser. The Auctioneer may impose reserve prices at the seller's request.

4.2 Seller’s Rights

Sellers may bid on their own lots and can withdraw any lot up to one week before the auction. If a seller purchases their own lot, standard buyer’s premiums and commissions apply.

4.3 Purchaser’s Responsibility

Purchasers are responsible for verifying the accuracy and condition of their purchases at delivery. The Auctioneer is not liable for discrepancies discovered after the lots have been removed.

4.4 Dispute Resolution

In case of bidding disputes, the Auctioneer has sole discretion to resolve the matter or re-offer the lot, regardless of prior sale status.

4.5 Finality of Bids

Bids are final once accepted by the online platform or acknowledged by Auction House staff.


5. Returns Policy

5.1 Non-Returnable Lots

All viewed lots are non-returnable. Postal bidders must notify the Auctioneer of disputes upon receipt and discuss the matter before any returns.

5.2 Return Deadlines

Returns are not accepted after twenty-one (21) days post-auction, as vendors are paid by that time. No returns for tampered lots.

5.3 Grading Disputes

The Auctioneer is not responsible for items that do not meet buyer expectations based on PCGS grading. No refunds will be issued for such reasons.


6. Postal Bidding

6.1 Bid Processing

Postal bids are recorded in the order received. If identical bids are submitted, the first received will win, subject to live bids.

6.2 Bid Confidentiality

All bids are handled with strict confidentiality.

6.3 Liability Disclaimer

The Auctioneer is not liable for errors from bids received via telephone or illegible handwriting. Bidders are encouraged to use block letters.

6.4 Late Bids

The Auctioneer accepts no responsibility for late bids submitted on auction day via phone, fax, or email.


7. Bidding Increments

Bidding increments are as follows:

  • $0 - $50: $5 increments
  • $51 - $200: $10 increments
  • $201 - $1,000: $25 increments
  • $1,001 - $5,000: $50 increments
  • $5,001 - $10,000: $100 increments
  • $10,001 - $20,000: $500 increments
  • $20,001 and above: $1,000 or at the Auctioneer's discretion

All mail-in bids must be submitted by 6:00 PM the day before the auction and are not valid until confirmed by the Auction House.

8. Auctioneer Bidding

8.1 Vendor Bidding

The Auctioneer may bid on behalf of the vendor or prospective purchaser. Such bids need not be explicitly stated and will be recorded.

8.2 Buyer Information

Purchasers may need to provide names, addresses, and/or a deposit on the purchase price at the sale's end.

8.3 Non-Compliance

Failure to comply with these Conditions may result in the re-sale of the lot by the Auctioneer.

8.4 Agent Bidding

Agents bidding for undisclosed clients do so at their own risk and are responsible for payment and delivery. The Auctioneer is not liable for defaults.

8.5 Minors

Bids from minors will not be accepted unless accompanied by a cash deposit or suitable guarantees.

9. Item Condition and Grading

9.1 Defective Items

Items with stated defects are non-returnable. Grading assessments reflect the describer's opinion and may differ from others' views.

9.2 Dispute Resolution

Disputes related to these Conditions will be resolved at the Auctioneer's discretion.

10. Buyer’s Commission

10.1 Commission Fee

A buyer's commission of twenty-two percent (22%) will be added to the final invoice for Purchasers.


11. Overpayment policy

11.1 Overpayments Below $10

If an overpayment of less than $10 is made, we will make reasonable efforts to contact you for refund instructions. This will include up to three (3) email attempts using the contact information provided.

11.2 Response Deadline

If no response is received within thirty (30) days from the date of the first email or by the settlement day of the auction (whichever is later), the overpayment will automatically be applied as an administrative fee to offset account management costs. By accepting these Terms and Conditions, you acknowledge and consent to this policy.

11.3 Exclusions

This policy does not apply to overpayments exceeding $10, which will be refunded in full upon request.
